The North Carolina courts follow statutory requirements, restrictions, and guidelines relative to child support. The court’s approach is more mathematical than you may imagine. When the parents’ combined gross income is $25,000 monthly or less, child support is calculated using these factors:

  • the number of children
  • time spent together by children and parents
  • parental gross income
  • financial contributions for medical insurance and child care
  • agreements from previous marriages for child support
  • the number of children from prior marriages and relationships
  • extraordinary expenses, such as private school tuition, travel expenses for children to visit with the parents, and extraordinary medical and dental expenses for the children

Ultimately, mediation provides the best opportunity to create solutions between parents that provide for the best interest of the children. Research shows agreements made through mediation are more willingly followed by both parties than those determined by the courts. Mediation allows for goal oriented planning which helps you make solid decisions for the future of your children. Strategic negotiation ensures that those goals can be met. When parents cannot find common ground for the best interest of the children, there are generally other elements to be considered that extend beyond the ending of a marriage.
